MOVE & MEET - TERMS & CONDITIONS

1. GENERAL INFORMATION
Welcome to MOVE & MEET Limited ("MOVE & MEET", "we", "us", "our"). These Terms & Conditions ("Terms") govern your access to and use of our events, services, and related websites and social media platforms. By participating in our events or using our services, you agree to comply with and be bound by these Terms.

2. THESE TERMS & CONDITIONS
2.1. These Terms and Conditions (“T&Cs”) set out and comprise all of the legal terms applying between us and you in relation to your registration to participate and your participation in any MOVE & MEET events (each an “Event”) taking place in any country, city or place of registration (the “Territory”). They are part of the agreement that you are concluding with us when registering for an Event.
2.2. We reserve the right at our discretion to amend these T&Cs (and the format, date and structure of any Event), including if there is a change in the Applicable Laws or amendments due to changes in the event structure. If we do implement such changes, we will notify you of any such changes in advance.

3. EVENT REGISTRATION
3.1. To register to participate in any Event, you must via our website or app:
3.1.1. truthfully complete the set up or registration of an account or profile via the Move & Meet app (which is available on both android and IOS). In doing so, you must not use any false information or misrepresent the information of another person as applying to you.
Anyone who uses false or misleading information or documents in order to gain entry will have their registration cancelled and may be banned from participating in future Events. The use of false documents to obtain an entry may be a criminal offence;
3.1.2. provide your consent to the storage and processing of your data in accordance with the provisions of the applicable general data protection regulations and our privacy policy as set out on our website or app. www.moveandmeet.co.uk/privacypolicy
3.1.3. confirm your acknowledgement and acceptance of these T&Cs; and
3.1.4. agree to pay Move & Meet the fee payable by you to Move & Meet in consideration of your participation in the relevant Event as detailed on our Event booking platform.
3.2. Your completion of the above registration process constitutes a binding, irrevocable and unconditional offer by you to participate in the relevant Event in accordance with these T&Cs.
3.3. Once we confirm your registration by email and request to further personalize your ticket, a binding contract is entered into between us for you to participate in the relevant Event in accordance with, and subject to, these T&Cs (to the exclusion of all other terms and conditions save where expressed to the contrary in these T&Cs).
3.4. In order to participate in any Event, you must:
3.4.1. be eighteen (18) years of age or older,
3.4.2. be in generally good health with no medical condition that may make it dangerous for you to participate in physical activity/exercise.
3.4.3. notify Move & Meet of any potential risk/concern and/or any past/present health condition.
3.4.4. be duly registered to participate in such Event;
3.4.5. have your Event ticket as documented by an email confirmation issued by Move & Meet only.
3.5. You are solely responsible for assessing the health requirements for your participation in any Event. You acknowledge and agree that: (i) your state of health may change during the period between registering to participate in an event and such participation (including due to viral infection, illness or injury); and (ii) you bear this risk alone and may not terminate this contract due to subsequent viral infection, illness or injury.
3.6. Attendees must be at least eighteen (18) years of age to purchase tickets and attend events hosted by Move & Meet. If you are under 18 and purchase a ticket, you will be denied entry to the event and will not receive a refund. All attendees must be over the age of 18 at the time of registration via the Move & Meet app and/or when booking an event through our website.
3.7. Move & Meet reserves the right to exclude you from participating or attending an Event at any time and without any right to a refund of the Fee, or associated costs of participation in the Event if:
3.7.1. you provide false personal information to us, including during registration;
3.7.2. there is reasonable suspicion that you are not in generally good health;
3.7.3. your actions and/or omissions (whether before, during or after any Event) endanger the safety of any other participants or our staff members or other representatives; or
3.7.4. there is reasonable suspicion that you are in possession or under the influence of any substances (performance-enhancing or otherwise) at the time of any Event.

4. TRANSFER / CHANGE OF TICKET OWNER
4.1    Non-Refundable Tickets: All ticket sales are final and non-refundable. Any purchase of Move & Meet’s listed events, merchandise or other goods/services are non-refundable.
4.2    Ticket Transfer Policy: Tickets purchased for Move & Meet events may be transferred to another individual, provided that the individual is personally known to the original ticket owner. To effectuate a ticket transfer, the following conditions must be met:
4.1.1    Notification: The original ticket owner must notify Move & Meet of the intended transfer by providing the full name, email address, and mobile number of the new participant. This notification must be sent via email to hello@moveandmeet.co.uk at least four (4) days (96 hours) prior to the event date.
4.1.2    Registration: The new participant is required to download the Move & Meet app and register an account prior to attending the event. Failure to do so may result in denial of entry, for which Move & Meet will not be held liable.
4.1.3    Pre-Order Adherence: The new ticket holder must adhere to the original ticket holder’s pre-selected food and drink order. Changes to the food and drink order are only permissible if the ticket transfer is completed at least seven (7) days prior to the event date. In such cases, the new ticket holder must communicate their preferred food and drink choices via email to hello@moveandmeet.co.uk
4.1.4    Dietary Requirements: It is the responsibility of the new ticket holder to notify Move & Meet of any dietary requirements immediately upon transfer of the ticket. Move & Meet will make reasonable efforts to accommodate such requirements but will not be held responsible for any failure to do so if notified late.
4.1.5    Compliance: By accepting the ticket transfer, the new participant agrees to comply with all the terms and conditions of Move & Meet events.
4.3    Move & Meet reserves the right to refuse any ticket transfer request that does not comply with the above terms or if it deems the transfer not in the best interest of the event. Move & Meet shall not be liable for any losses or damages arising from the inability to transfer a ticket or from non-compliance with these terms.

4.4. Event Rescheduling Policy
Move & Meet reserves the right to reschedule any event at its sole discretion if the event does not meet the minimum attendance requirement. The minimum number of attendees is specific to each event and is determined by Move & Meet based on the number of tickets available.
In the event of rescheduling due to insufficient ticket sales:
•    Notification: Attendees will be informed of the rescheduling via the contact information provided during registration. Move & Meet will provide as much advance notice as possible.
•    Options for Attendees: If an event is rescheduled, attendees have the following options:
o    Ticket Transfer: Attendees may transfer their ticket to another scheduled event of their choice, subject to availability.
o    Refund: If attendees are unable to find a suitable rescheduled date, they may request a refund. Refund requests must be made within a specified time frame, as communicated in the rescheduling notification.
Move & Meet is not liable for any costs, losses, or damages incurred by attendees as a result of rescheduling. By purchasing a ticket, attendees agree to comply with this policy and acknowledge that rescheduling is sometimes necessary to maintain the quality and environment of Move & Meet events.
4.5 App Resale Option (Sold Out Events Only)
4.5.1 Tickets remain strictly non-refundable. However, as a gesture of flexibility, Move & Meet may permit ticket holders to resell their ticket via the official Move & Meet app where the relevant Event is fully sold out.
4.5.2 The resale option is only available until close of play (11:59pm UK time) on the Monday of the week in which the Event takes place. After this time, resale will no longer be permitted.
4.5.3 Resale of tickets is not guaranteed. Listing a ticket for resale does not guarantee that it will be purchased. Move & Meet accepts no liability if a ticket is not resold.
4.5.4 If a ticket is successfully resold via the app, the original ticket holder will receive a credit to their Move & Meet account equal to the original ticket price paid (excluding any processing or service fees, if applicable). No monetary refund will be issued.
4.5.5 Any credit issued must be used to book another Move & Meet event taking place within two (2) months from the date the ticket is successfully resold via the Move & Meet app. Credits are non-transferable, non-exchangeable for cash, and will expire automatically after the two-month period if unused.
4.5.6 Move & Meet reserves the right to withdraw or amend the resale functionality at its sole discretion.

5. THE FEE, CHARITY FEE, SERVICE FEE AND TERMS OF PAYMENT
5.1. All listed prices on our registration page are stated to be inclusive of VAT.
5.2. The Fee of the Event is due for payment immediately upon Event registration. Such payments may be made by:
5.2.1. credit or debit card;
5.2.2. Google Pay;
5.2.3. Apple Pay; or
5.2.4. Visa Checkout.
5.3. If payment is not processed for any reason whatsoever, Move & Meet is entitled to terminate our contract immediately without liability. You shall be liable for all costs reasonably associated with such termination. Any issues with registering or booking an event, please email Move & Meet at hello@moveandmeet.co.uk

6. ARRIVAL / ACCESS TO THE EVENT
6.1. Upon arrival at an Event and subject to your presentation of:
6.1.1. your official registration confirmation email
6.1.2. your proof of identity; and
6.1.3. if applicable, proof of your state of health,
6.2. Move & Meet reserves the right to request further explanation from you regarding your health status. If, at any Event, you display typical symptoms of illness (such as shortness of breath, cough or fever) or other indications of a viral infection, Move & Meet may remove you from the Event in question with no refund of the Fee.
6.3 Missed Introductions: If you arrive late and miss the introduction to a fitness class, you will not be permitted to join. This policy is enforced to ensure the health and safety of all participants.
6.4 No Shows: If you do not attend the event and fail to inform us, you will not be entitled to any refund or transfer.

7. POSTPONEMENT / CANCELING OF THE EVENTS
7.1. Move & Meet is under no obligation to hold the Events and, subject to the remainder of this clause 7, may without liability postpone or cancel, or change the time or location of, any or all of the Events for any reason, including due to:
7.1.1. circumstance not within Move & Meet’s reasonable control (including circumstances leading to so called “economic impossibility”),
7.1.2. lack of necessary permits to run the Event,
7.1.3. a decision to protect the safety of any members of the public or Event participants, or
7.1.4. any changes to the Applicable Laws.
7.2. If any Event for which you are registered is cancelled altogether, you shall be entitled to a free rebooking to an alternative Move & Meet event of your choice taking place within the next 2 months. If an alternative suitable date can’t be found, Move & Meet refund the Fee to you.
7.3. If any Event for which you are registered is postponed, your contract with us (including these T&Cs) shall remain unaffected and your registration shall remain valid for the next rescheduled edition of the postponed Event in question.

8. PARTICIPATION / INFRINGEMENT RISK, LIABILITY, LIMITATION AND DISCLAIMER OF LIABILITY
8.1.    Liability Waiver: MOVE & MEET is not liable for any injuries, damages, or losses that occur during our events, including but not limited to during transit between workout sessions, brunch, and restaurant venues. This includes any incidents at the fitness studio where workouts take place or at the restaurant where food and drink are served. Participants waive any claims against MOVE & MEET and third-party venues arising from these activities.
8.2.    Participation in any Event is at your own risk and requires that you are healthy and in good physical condition. It is your responsibility to check your health beforehand. With your registration, accreditation and participation, you expressly declare that you are aware of the specific dangers of the Event and that there are no health concerns regarding your participation.
8.3.    By registering for any Event, you acknowledge that you can get injured or infected with viruses during the Event in the course of your participation.
8.4.    Subject to clause 8.5. of these T&Cs, and to the maximum extent permitted by law, Move & Meet hereby excludes any liability for loss, damage or injury to you and/or your property arising under our contract or in connection with any Move & Meet event, including any indirect or consequential loss or damage, such as loss of enjoyment or travel or accommodation costs, regardless of whether the loss or damage: (i) would arise in the ordinary course of events; (ii) is reasonably foreseeable; or (iii) is in the contemplation of the parties, or otherwise.
8.5.    Notwithstanding any provision in these T&Cs, Move & Meet does not seek to exclude or limit its liability (i) for fraud or fraudulent misrepresentation; (ii) for death or personal injury caused by Move & Meet negligence or the negligence of any of its officers, employees or agents; (iii) damages of other financial loss caused as a consequence of our gross negligence, or (iv) for any other matter for which it is not possible to exclude or limit liability by Applicable Laws (including your statutory rights and rights as a consumer).
8.6.    We assume no liability for lost clothing, valuables and equipment belonging to participants that were not handed over to us for safekeeping. You should therefore be insured accordingly.
8.7.    Insofar as Move & Meet liability is excluded or limited, this also applies to the personal liability of its employees, representatives and vicarious agents.

9. PRIVACY AND DATA PROTECTION, PHOTO AND IMAGE RIGHTS
9.1. You acknowledge and agree that Move & Meet may use any information provided by you for the following purposes:
9.1.1. the enforcement of Move & Meet’s legal rights;
9.1.2. to send you relevant information relating to the Events;
9.1.3. to notify you of events, activities, publications and services that may be of interest to you should you consent to receiving these from Move & Meet;
9.1.4. to notify you of any amendments to these T&Cs and/or any of the Events in accordance with clause 2.1; and
9.1.5. to comply with the Applicable Laws.
9.2. Move & Meet is entitled, either itself or through authorised third parties, to make audio, audio-visual recordings and/or stills/photographs of the Events as well as record the name, image and voice of the participants during the course of the event, including the introduction, duration of workout, walk in between the fitness studio & restaurant and during brunch social (collectively "Media Content") without any obligation for compensation. The Media Content shall clearly qualify as event content thereby generally including any individual portraits or close-ups of participants or spectators. Move & Meet and/or its authorized third parties may use such Media Content for documentation, information and advertising purposes in all media on a world-wide basis for a period of five (5) years thereafter and allow all official Move & Meet partners and/or sponsors the same use and application.
9.3. Move & Meet shall use best efforts to ensure that the Media Content produced at the Events will only be used in connection with Move & Meet, even if passed on to authorised third parties.
9.4. Move & Meet has the right to store, use, broadcast, display and/or reproduce all Media Content on all media, including but not limited to radio, television, cinema, at events, on data carriers or on the Internet to be published without restriction. This also includes the right to make changes, edits, interruptions, deletions or other modifications to the Media Content and to use it without restriction as well as to transfer these rights to third parties.
9.5. You hereby approve the publication of any of the Media Content without any form of reimbursement, compensation, or payment if you are mentioned, depicted or reproduced on any of the Media Content. For any data protection rights issues please refer to our privacy policy.
9.6. In relation to medical matters, you agree that:
9.6.1. your personal information may be stored, used, and disclosed by Move & Meet in connection with the organization and administration of the Events and for the compilation of statistical information. If you become ill during or after an Event and/or receive medical attention or treatment either from medical staff, other medical service providers to the Events, or any doctor or hospital, you authorise such persons to provide details (including details of medical treatment) to Move & Meet or others authorised by them; and
9.6.2. you consent to medical assistance and/or medical care being given to you in the case of illness, injury or an emergency situation, should this occur during an Event, such assistance to be given by medical staff or other medical services (which may include the use of anaesthetics).
9.7. You shall not take, record and/or transmit any sound, image and/or description of the Events other than for your exclusive, private and domestic use (which, for the avoidance of doubt and by way of example only, shall not include recording and/or transmitting any sound, image and/or description of the Events for any commercial purposes).
9.8. Marketing Communications and Third-Party Partners
By registering for and/or participating in any Event, you acknowledge and agree that Move & Meet may contact you by email, SMS and/or other electronic communications with marketing communications relating to Move & Meet events, services, partnerships, promotions and community updates. You further acknowledge and agree that Move & Meet may share your contact details with carefully selected third-party partners, sponsors and collaborators for the purpose of sending you relevant marketing communications relating to products, services or experiences connected to Move & Meet events. You may opt out of receiving marketing communications at any time by using the unsubscribe link provided in communications or by contacting. This clause is subject to applicable data protection laws and our Privacy Policy.

10. GENERAL
10.1. These T&Cs have been drafted in the English language and may be translated into other languages. In the event of any discrepancy between the English and any translated version, the respective version representing the official language of the Territory shall prevail.
10.2. The contract between us constitutes the entire agreement between the parties and no party shall have any claim or remedy in respect of any statement, representation, warranty or undertaking, made by or on behalf of any other party in relation to our contract which is not already set out in these T&Cs.
10.3. For UK & Ireland please insert: Any person not a party to our contract shall have no rights under the Contracts (Rights of Third Parties) Act 1999.
10.4. The contract between us (including these T&Cs) is governed by the laws of England and Wales. The parties agree that the courts of England and Wales have exclusive jurisdiction to settle any dispute arising under or in connection with our contract. Notwithstanding the foregoing:
10.4.1. Move & Meet reserves the right (exercisable at its sole discretion) to pursue legal proceedings against you in either: (a) the courts of England and Wales. If Move & Meet elects to issue proceedings in the courts of England, such proceedings shall be governed and interpreted in accordance with English law; and
10.4.2. you reserve the right (exercisable at your sole discretion) to pursue legal proceedings against Move & Meet in either: (a) (for English/Welsh residents registered for an Event in England or Wales) the courts of England and Wales; (b) (for Scottish residents registered for an Event in Scotland) the courts of Scotland; or (c) (for Irish residents registered for an Event in the Republic of Ireland) the courts of the Republic of Ireland. All such proceedings shall be governed and interpreted in accordance with the laws of the jurisdiction in which those proceedings are issued.
